Terms and Conditions
All orders accepted are subject to our Bitzel’s Chocolate Terms & Conditions herein. Acceptance is giving us by a written or electronic signature or confirmation, submitting an order or paying for a Product or Service.
If you don’t want to accept these T&Cs, don’t do any of these things.
When you accept, you're telling us that you are of legal age (you are either legally emancipated or have reached the age of majority in your jurisdiction) and that you are able to enter a contract. If you accept on behalf of an organization, you're telling us that you are authorized to bind that organization, and references to "you" in these T&Cs may mean the organization.
SHIPPING
We currently only ship to the contiguous United States. Please note that we cannot ship to P.O. Boxes. We are not responsible for delivery delays experienced by UPS to weather or mechanical error and are, therefore, unable to offer refunds for those reasons.
No Signature Required
All orders are shipped “no signature required” which means the package will be left at the shipping address, which may mean simply left on a residential doorstep. We are not responsible if the package is lost or stolen or melted after UPS has completed the delivery.
You must notify Us, in writing, that an Order Is Incomplete, Incorrect or Damaged within 48 hours.
TEMPERATURE CONDITIONS
All shipping is via UPS. When temperatures exceed 70°F, overnight shipping must be used. We only ship Monday – Thursday to ensure orders arrive within the week. Please note: UPS does NOT guarantee overnight shipping. If the destination city’s temperature is 70 degrees or warmer, please choose the Expedited shipping option. We’ll provide a styrofoam lined container and ice packs to protect your chocolate. If you have chosen ground shipping, we are not responsible if the chocolates arrive melted and will not offer any refund. Please note that late spring and all through the summer, we only offer Expedited shipping to most states.
GENERAL RETURN / REFUND POLICY
Being a food product, all sales are final and no returns and/or refunds are allowed unless it is a manufacturing defect. Please contact us at info@bitzelschocolate.com should you need assistance.
Bitzel’s Chocolate is not responsible for damage during shipping. All packages are shipped insured. Should damage occur, please follow the produces outlined at https://www.ups.com/us/en/support/file-a-claim
RETURN POLICY FOR PERSONALIZED PRODUCTS
Bitzel’s Chocolate is not responsible for design or logo errors by the customer. We will use our professional judgment with regard to placement of text, design, and the appropriate size and position on personalized items. We cannot accept returns on personalized items. If you have a question regarding your order, please contact us within five (5) days of receiving your order and have your order number for referencing. If we are in error, we will reprint and ship your order immediately at no cost to you. Bitzel’s Chocolate is not responsible for any consequential damages as a result of an error. Our liability is specifically limited to the value of the personalized product we manufactured. Shipping charges cannot be credited and return shipping is the customer’s responsibility.
BILLING / BILLING DISPUTES
All orders are to be paid in full at the time of accepted quote and prior to manufacture unless Terms are approved prior. If amounts owed are not paid within the approved terms, interest will accrue on all past due amounts at the rate of 1.5% per month or the highest rate of interest allowed by law (whichever is greater), calculated from the date the amount was due until the date that payment is received. If your account becomes overdue, we will be entitled to reimbursement for the reasonable costs of collection, including reasonable attorneys’ fees and expenses.
All orders are considered complete and accepted 48hours after receipt of product. You must notify Us, in writing, that an Order Is Incomplete, Incorrect or Damaged within 48 hours.
